au domicile de chacun des parents ou au domicile de l’un d’eux. A la demande de l’un des parents ou en cas de d\u00e9saccord entre eux sur le mode de r\u00e9sidence de l’enfant, le juge peut ordonner \u00e0 titre provisoire une r\u00e9sidence en alternance dont il d\u00e9termine la dur\u00e9e. Au terme de celle-ci, le juge statue d\u00e9finitivement sur la r\u00e9sidence de l’enfant en alternance au domicile de chacun des parents ou au domicile de l’un d’eux.<\/p>\n Lorsque la r\u00e9sidence de l’enfant est fix\u00e9e au domicile de l’un des parents, le juge aux affaires familiales statue sur les modalit\u00e9s du droit de visite de l’autre parent. Ce droit de visite, lorsque l’int\u00e9r\u00eat de l’enfant le commande, peut \u00eatre exerc\u00e9 dans un espace de rencontre d\u00e9sign\u00e9 par le juge \u00bb.<\/p>\n Article 373-2-6<\/span><\/p>\n Le juge du Tribunal de grande instance d\u00e9l\u00e9gu\u00e9 aux affaires familiales r\u00e8gle les questions qui lui sont soumises dans le cadre du pr\u00e9sent chapitre en veillant sp\u00e9cialement \u00e0 la sauvegarde des int\u00e9r\u00eats des enfants mineurs. Le juge peut prendre les mesures permettant de garantir la continuit\u00e9 et l\u2019effectivit\u00e9 du maintien des liens de l\u2019enfant avec chacun de ses parents. Il peut notamment ordonner l\u2019inscription sur le passeport des parents de l\u2019interdiction de sortie de l\u2019enfant du territoire fran\u00e7ais sans l\u2019autorisation des deux parents.<\/p>\n <\/p>\n Article 373-2-7<\/span><\/p>\n Les parents peuvent saisir le juge aux affaires familiales afin de faire homologuer la convention par laquelle ils organisent les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale et fixent la contribution \u00e0 l\u2019entretien et \u00e0 l\u2019\u00e9ducation de l\u2019enfant. A l\u2019effet de faciliter la recherche par les parents d\u2019un exercice consensuel de l\u2019autorit\u00e9 parentale, le juge peut leur proposer une mesure de m\u00e9diation et, apr\u00e8s avoir recueilli leur accord, d\u00e9signer un m\u00e9diateur familial pour y proc\u00e9der. civil, instaur\u00e9 par la loi du 4 mars 2002, offre au juge la possibilit\u00e9 de fixer la r\u00e9sidence de l\u2019enfant en alternance chez chacun de ses parents. L\u2019objectif clairement affich\u00e9 par le l\u00e9gislateur est de renforcer le principe de coparentalit\u00e9 en permettant \u00e0 l\u2019enfant de vivre avec chacun de ses parents.<\/p>\n Pour autant, l\u2019alternance n\u2019est pas synonyme de partage \u00e9galitaire du temps entre le p\u00e8re et la m\u00e8re de l\u2019enfant, comme le pr\u00e9cise clairement cet arr\u00eat. Le juge reste libre dans son appr\u00e9ciation du partage du temps entre la r\u00e9sidence de la m\u00e8re et celle du p\u00e8re. Son choix doit \u00eatre guid\u00e9 et motiv\u00e9 par le seul int\u00e9r\u00eat de l\u2019enfant.<\/p>\n Les juges refusent au motif qu\u2019en raison du jeune \u00e2ge des enfants, une p\u00e9riode de cinq semaines est trop \u00e9lev\u00e9e et ne permet pas aux enfants de se procurer des rep\u00e8res. Ils prononcent alors une r\u00e9sidence altern\u00e9e d\u2019une semaine sur deux, laquelle revient \u00e0 octroyer \u00e0 la m\u00e8re une garde plus importante qu\u2019au p\u00e8re.<\/p>\n La Cour de cassation approuve la solution au motif que \u00ab l’article 373-2-9 du code civil n’impose pas, pour que la r\u00e9sidence d’un enfant soit fix\u00e9e en alternance au domicile de chacun des parents, que le temps pass\u00e9 par l’enfant aupr\u00e8s de son p\u00e8re et de sa m\u00e8re soit de m\u00eame dur\u00e9e \u00bb.<\/p>\n Si cette solution est parfaitement logique au regard de l\u2019int\u00e9r\u00eat de l\u2019enfant, on imagine cependant les difficult\u00e9s qu\u2019elle risque de susciter relativement au calcul des parts fiscales et des droits aux allocations familiales de chacun des parents !<\/p>\n Sur le deuxi\u00e8me moyen, pris en ses trois branches :<\/p>\n Attendu que M. M… fait grief \u00e0 l’arr\u00eat attaqu\u00e9 (Rennes, 9 mai 2006), qui a prononc\u00e9 le divorce des \u00e9poux M…-C…, d’avoir dit que la r\u00e9sidence des enfants communs, Alys\u00e9e n\u00e9e le 21 juin 1994 et Alexandre, n\u00e9 le 20 mai 1997, sera altern\u00e9e au domicile des parents par p\u00e9riodes d’une semaine : les premi\u00e8re, troisi\u00e8me et \u00e9ventuellement cinqui\u00e8me semaines de chaque mois chez le p\u00e8re, les seconde et quatri\u00e8me semaines de chaque mois chez la m\u00e8re, alors, selon le moyen :<\/p>\n 1\u00b0\/ que la contradiction entre les motifs et le dispositif \u00e9quivaut \u00e0 un d\u00e9faut de motifs ; qu’en retenant, dans ses motifs, que l’emploi de M. M… se d\u00e9composait en alternance de p\u00e9riodes de 5 semaines de travail \u00e0 l’\u00e9tranger et de 5 semaines de repos en France, ce dont il s’\u00e9vin\u00e7ait que ce dernier serait insusceptible de s’occuper de ses enfants une semaine sur deux lorsqu’il n’\u00e9tait pas en France, tout en d\u00e9cidant que la r\u00e9sidence des enfants M… serait altern\u00e9e au domicile de leurs parents par p\u00e9riodes d’une semaine sur deux, la Cour d’appel a viol\u00e9 l’article 455 du nouveau code de proc\u00e9dure civile ;<\/p>\n 2\u00b0\/ que la r\u00e9sidence altern\u00e9e implique que le temps de pr\u00e9sence de l’enfant aupr\u00e8s de chacun de ses parents, co-titulaire de l’autorit\u00e9 parentale, soit r\u00e9parti sur une base \u00e9galitaire ; qu’en d\u00e9cidant que la r\u00e9sidence des enfants M… serait altern\u00e9e au domicile de leurs parents par p\u00e9riodes d’une semaine sur deux, tout en constatant que M. M…, co-titulaire de l’autorit\u00e9 parentale avec Mme C…, travaillait \u00e0 l’\u00e9tranger par p\u00e9riodes de 5 semaines suivies de 5 semaines de repos en France, ce dont il r\u00e9sultait n\u00e9cessairement que le temps de pr\u00e9sence des enfants M… ne serait pas r\u00e9parti entre leurs parents sur une base \u00e9galitaire, la Cour d’appel a viol\u00e9 l’article 373-2-9 du code civil ;<\/p>\n 3\u00b0\/ qu’\u00e0 supposer m\u00eame que la r\u00e9sidence altern\u00e9e n’implique pas que le temps de pr\u00e9sence de l’enfant aupr\u00e8s de chacun de ses parents, co-titulaire de l’autorit\u00e9 parentale, soit r\u00e9parti sur une base \u00e9galitaire, il appartient aux juges du fond de s’expliquer sur les raisons pour lesquelles ils retiennent une r\u00e9partition in\u00e9galitaire ;<\/p>\n qu’en d\u00e9cidant que la r\u00e9sidence des enfants M… serait altern\u00e9e au domicile de leurs parents par p\u00e9riodes d’une semaine sur deux, tout en constatant que M. M…, co-titulaire de l’autorit\u00e9 parentale avec Mme C…, travaillait \u00e0 l’\u00e9tranger par p\u00e9riodes de 5 semaines suivies de 5 semaines de repos en France, ce dont il r\u00e9sultait n\u00e9cessairement que le temps pass\u00e9 par les enfants M… aupr\u00e8s de leur p\u00e8re et de leur m\u00e8re ne serait pas r\u00e9parti avec \u00e9galit\u00e9, sans toutefois s’expliquer sur les raisons pour lesquelles cette r\u00e9partition devait \u00eatre in\u00e9galitaire, la cour d’appel a priv\u00e9 sa d\u00e9cision de base l\u00e9gale au regard de l’article 373-2-9 du code civil ;<\/p>\n Mais attendu, que l’article 373-2-9 du code civil n’impose pas, pour que la r\u00e9sidence d’un enfant soit fix\u00e9e en alternance au domicile de chacun des parents, que le temps pass\u00e9 par l’enfant aupr\u00e8s de son p\u00e8re et de sa m\u00e8re soit de m\u00eame dur\u00e9e ; que les juges du fond peuvent, si l’int\u00e9r\u00eat de l’enfant le commande, compte tenu des circonstances de la cause, d\u00e9cider d’une alternance aboutissant \u00e0 un partage in\u00e9gal du temps de pr\u00e9sence de l’enfant aupr\u00e8s de chacun de ses parents ;<\/p>\n qu’ayant relev\u00e9, d’une part, que M. M… avait un emploi stable qui pr\u00e9sentait la particularit\u00e9 de s’effectuer par rotations de cinq semaines de travail \u00e0 l’\u00e9tranger, en Arabie Saoudite, suivies de cinq semaines de repos en France, d’autre part, que compte tenu notamment de l’\u00e2ge des enfants, la dur\u00e9e du s\u00e9jour de cinq semaines cons\u00e9cutives chez chacun des parents, ordonn\u00e9e au titre des mesures provisoires, \u00e9tait beaucoup trop longue, avait connu des dysfonctionnements et occasionn\u00e9e aux enfants des troubles r\u00e9actionnels attest\u00e9s par un certificat \u00e9tabli par une psychologue ;<\/p>\n enfin, que s’il apparaissait logique de tenir compte de la particularit\u00e9 de l’emploi du p\u00e8re, ce qui devait primer avant tout \u00e9tait l’int\u00e9r\u00eat des enfants \u00e0 qui il convenait de procurer des rep\u00e8res que ne permettait pas l’alternance de cinq semaines ou plus, les juges du fond ont, dans l’exercice de leur pouvoir souverain, sans se contredire et par une d\u00e9cision motiv\u00e9e, d\u00e9cid\u00e9 de fixer la r\u00e9sidence des enfants une semaine sur deux chez chacun des parents, ce qui, compte tenu des contraintes professionnelles de M. M…, aboutissait \u00e0 ce que le temps de pr\u00e9sence des enfants chez leur m\u00e8re soit plus important, ce que n’interdisent pas les dispositions du texte pr\u00e9cit\u00e9 ;<\/p>\n D’o\u00f9 il X… et Mme Y… se sont mari\u00e9s le 29 juin 1991, qu\u2019une enfant, Emeline, est n\u00e9e le 18 f\u00e9vrier 1994 de leur union ; que le divorce a \u00e9t\u00e9 prononc\u00e9 aux torts partag\u00e9s des \u00e9poux et une enqu\u00eate sociale ordonn\u00e9e concernant les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale, la r\u00e9sidence habituelle de l\u2019enfant et les droits de visite et d\u2019h\u00e9bergement ; qu\u2019\u00e0 la demande du juge saisi, un avocat, intervenant pour l\u2019enfant, a \u00e9t\u00e9 d\u00e9sign\u00e9 et entendu au cours de la proc\u00e9dure ;<\/p>\n Sur le premier moyen, pris en ses diverses branches :<\/p>\n Attendu que M. X… fait grief \u00e0 l\u2019arr\u00eat confirmatif attaqu\u00e9 (N\u00eemes, 18 juin 2003) d\u2019avoir statu\u00e9 sur les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale en pr\u00e9sence et sur l\u2019intervention de l\u2019avocat d\u00e9sign\u00e9 pour d\u00e9fendre les int\u00e9r\u00eats de l\u2019enfant, alors, selon le moyen :<\/p>\n 1\u00b0\/ que l\u2019intervention de l\u2019enfant mineur n\u2019est pas recevable dans les instances relatives aux modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale ; qu\u2019en admettant l\u2019intervention d\u2019Emeline, repr\u00e9sent\u00e9e par son avocat, dans l\u2019instance sur les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale la concernant, la cour d\u2019appel a viol\u00e9 les articles 1115 du nouveau Code de proc\u00e9dure civile, 373-2-8 et 373-2-11 du Code civil ;<\/p>\n 2\u00b0\/ que seul peut repr\u00e9senter le mineur dans une proc\u00e9dure le concernant, lorsque les int\u00e9r\u00eats du mineur apparaissent en opposition avec ceux de ses repr\u00e9sentants l\u00e9gaux, un mandataire ad hoc d\u00e9sign\u00e9 par le juge des tutelles, conform\u00e9ment \u00e0 l\u2019article 388-2 du Code civil ;<\/p>\n qu\u2019en reconnaissant \u00e0 l\u2019avocat d\u2019Emeline le pouvoir de repr\u00e9senter celle-ci dans l\u2019instance relative aux modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale la concernant, bien que cet avocat ait \u00e9t\u00e9 d\u00e9sign\u00e9 par le b\u00e2tonnier de son ordre, et non par le juge, la cour d\u2019appel a viol\u00e9 l\u2019article 388-2 du Code civil ;<\/p>\n 3\u00b0\/ que lorsqu\u2019il se prononce sur les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale, le juge prend en consid\u00e9ration les sentiments exprim\u00e9s par le mineur dans les conditions pr\u00e9vues \u00e0 l\u2019article 388-1 du Code civil ; que, selon ce texte, m\u00eame s\u2019il peut \u00eatre accompagn\u00e9 par un avocat, seul le mineur lui m\u00eame peut \u00eatre entendu par le juge ou la personne d\u00e9sign\u00e9e par le juge \u00e0 cet effet ;<\/p>\n qu\u2019en statuant au vu des sentiments pr\u00e9tendument exprim\u00e9s par l\u2019enfant tels qu\u2019ils lui ont \u00e9t\u00e9 rapport\u00e9s par son avocat, d\u00e9sign\u00e9 par le b\u00e2tonnier de son ordre, sans entendre elle m\u00eame l\u2019enfant ou le faire entendre par une personne d\u00e9sign\u00e9e par elle \u00e0 cet effet, la cour d\u2019appel a viol\u00e9 les articles 373-2-11 et 388-1 du Code civil ;<\/p>\n 4\u00b0\/ que le juge doit, en toutes circonstances, faire observer et observer lui-m\u00eame le principe de la contradiction ; qu\u2019en fondant sa d\u00e9cision sur les propos attribu\u00e9s \u00e0 Emeline tel qu\u2019exprim\u00e9s \u00e0 l\u2019audience par son avocat, qui n\u2019en a pas fait de communication \u00e9crite pr\u00e9alable, et sans qu\u2019il r\u00e9sulte ni des \u00e9nonciations de l\u2019arr\u00eat attaqu\u00e9, ni des pi\u00e8ces de la proc\u00e9dure, que le juge ait invit\u00e9 les parties, M. X… et Mme Y…, \u00e0 en d\u00e9battre, la cour d\u2019appel a viol\u00e9 le principe du contradictoire et l\u2019article 16 du nouveau Code de proc\u00e9dure civile ;<\/p>\n Mais attendu que c\u2019est \u00e0 bon droit et en consid\u00e9ration de l\u2019int\u00e9r\u00eat sup\u00e9rieur de l\u2019enfant au sens de l\u2019article 3.1 de la convention de New-York du 26 janvier 1990, et de son droit \u00e0 \u00eatre entendu dans toute proc\u00e9dure le concernant consacr\u00e9 par l’article 12-2 du m\u00eame trait\u00e9, que la cour d\u2019appel, sans lui accorder la qualit\u00e9 de partie \u00e0 la proc\u00e9dure et sans confier ses int\u00e9r\u00eats \u00e0 un administrateur ad hoc, l\u2019administration des biens du mineur n\u2019\u00e9tant pas en cause, a pris l\u2019initiative de lui faire d\u00e9signer un avocat afin de recueillir ses sentiments et d\u2019en faire \u00e9tat lors de l\u2019audience, \u00e9tant relev\u00e9 que la juridiction saisie a toujours, en tout \u00e9tat de la proc\u00e9dure, la possibilit\u00e9 de proc\u00e9der \u00e0 l\u2019audition personnelle de l\u2019enfant, soit \u00e0 sa demande, soit si les circonstances rendent cette mesure utile ou n\u00e9cessaire ;<\/p>\n qu\u2019elle a ainsi fait une exacte application des textes pr\u00e9cit\u00e9s ; que le moyen n\u2019est fond\u00e9 en aucune de ses branches ;<\/p>\n Sur le second moyen, pris en ses deux branches :<\/p>\n Attendu que M. X… fait encore grief \u00e0 l\u2019arr\u00eat d\u2019avoir maintenu chez Mme Y… la r\u00e9sidence de l\u2019enfant, alors, selon le moyen :<\/p>\n 1\u00b0\/ que le juge qui se prononce sur les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale ne doit prendre en consid\u00e9ration les renseignements qui ont \u00e9t\u00e9 recueillis dans les \u00e9ventuelles enqu\u00eates sociales qu\u2019\u00e0 condition qu\u2019ils soient toujours pertinents au jour o\u00f9 il statue ;<\/p>\n que M. X… avait soulign\u00e9, dans ses conclusions d\u2019appel, son changement de r\u00e9sidence \u00e0 la suite de l\u2019enqu\u00eate sociale et le fait qu\u2019il ne r\u00e9sidait d\u00e9sormais plus chez ses parents ;<\/p>\n qu\u2019en s\u2019appropriant les r\u00e9flexions de l\u2019enqu\u00eateur social sur les risques d\u2019aggravation du conflit parental en cas de fixation de la r\u00e9sidence chez le p\u00e8re, \u00e9mises quand celui-ci \u00e9tait domicili\u00e9 chez ses propres parents, sans rechercher si, en raison du changement de r\u00e9sidence de M. X…, ce risque n\u2019avait pas disparu, la Cour d\u2019appel a priv\u00e9 sa d\u00e9cision de base l\u00e9gale au regard des articles 373-2-11 et 373-2-9 du Code civil ;<\/p>\n 2\u00b0\/ que le juge qui se prononce sur les modalit\u00e9s d\u2019exercice de l\u2019autorit\u00e9 parentale doit prendre en consid\u00e9ration l\u2019aptitude de chacun des parents \u00e0 respecter les droits de l\u2019autre ; qu\u2019en s\u2019abstenant de rechercher, comme le lui demandait M. X… dans ses conclusions d\u2019appel, l\u2019aptitude de Mme Y… \u00e0 respecter les droits du p\u00e8re, compte tenu de son opposition syst\u00e9matique au maintien de relations entre Emeline et son p\u00e8re, relev\u00e9e notamment par le tribunal de grande instance de N\u00eemes dans son jugement du 23 avril 2001 ordonnant l\u2019enqu\u00eate sociale, la cour d\u2019appel a priv\u00e9 sa d\u00e9cision de base l\u00e9gale au regard des articles 373-2-11 et 373-2, alin\u00e9a 2, du Code civil ;<\/p>\n Mais attendu que c\u2019est dans l\u2019exercice de son pouvoir souverain d\u2019appr\u00e9ciation de la port\u00e9e notamment des derniers \u00e9l\u00e9ments de preuve produits par les parties et sans avoir \u00e0 les suivre dans le d\u00e9tail de leur argumentation, que la Cour d\u2019appel a, sans m\u00e9conna\u00eetre les textes pr\u00e9cit\u00e9s, maintenu la r\u00e9sidence de l\u2019enfant chez sa m\u00e8re, que le moyen ne saurait \u00eatre accueilli ;<\/p>\n PAR CES MOTIFS :<\/p>\n REJETTE le pourvoi ;<\/p>\n Pr\u00e9sident : M.
