style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\"><b>Old law:<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\">The\u00a0<a href=\"\/\/docs.google.com\/file\/d\/0B-iOqOKLc35PMDVlMGU3NTEtYWVlMy00MDE2LWIxYTYtMGY4Yzk2M2Q0ZTk2\/edit?hl=en\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>Family Code<\/b><\/span><\/a>\u00a0from 1954 allowed after divorce only \u201csole custody\u201d \u00a0arrangements. It was a statement there which said \u201cthe state protects the mother and the child\u201d \u00a0which tells you everything. Despite numerous claims many fathers made to the Constitutional Court after the communism ended (from 1990 till 2011) that article was never cancelled. Eventually the Family Code was replaced by the New Civil code in 01.10.2011 and since then also the joint custody (legal or physical) is allowed. \u00a0The new civil code made as a presumption that joint legal custody is in the best interest of the child but also allows joint physical custody (= shared custody) if both parents agree to such deal. \u00a0If they do not have an agreement the judge is obliged by law to grant a joint legal custody decision.<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\">Before\u00a0<b>01.10.2011\u00a0<\/b>only sole custody was possible for the judge. The judge was obliged to select\u00a0<span style=\"text-decoration: underline;\">one<\/span>parent who will receive the \u2018custody\u201d \u2013 in 80-85% of the cases was the mother. The rest are cases where the mother was not appearing to the trial (due to emigration many women are abroad the kids remaining for years with the father \u2013 in such cases yes the father will get the kid cause because<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; Either the mother did not show (being emigrated for many years)<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; Either the child was more than 10 years old and the law oblige the judge to listen to the kid \u2013 most of those kids living for many years with the father told they want to continue to stay with the father<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; Either in fact the kid was raised by the grandparents of the father and this was obvious by the judge who decided to continue this arrangement granting the custody to the father<\/span><\/p>\n<p><span style=\"color: #000080;\">If the both parent was available in the large majority of the cases 98-99% the mother got the custody despite sometimes mother with physical problems, with abuses against kids (violence. The law offered, in theory, the equal chances to win the custody but in fact , a very caring father never had any chance to win in front of the \u201cmaternal presumption\u201d that was applicable by the jurisprudence.<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\"><b>Start of the reform \u2013 the Law 272\/2004 to prepare the EU ascension:<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\">Personal relationship of the kid with both parents were introduced in the legislation with the law<a href=\"\/\/www.dreptonline.ro\/legislatie\/legea_protectiei_copilului.php%20\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>272\/2004<\/b><\/span><\/a>. \u00a0This\u00a0 law also introduced the idea that judge should decide based on the best interests of the child. In theory this gave equal changes to both parents to gain the custody of the kid. In practice this was abused by Judges. Still had value in introducing the idea that there is the right of the id to have personal relationship with the non-residential parent<\/span><\/p>\n<p><span style=\"color: #000080;\"><b>\u00a0<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\"><b>New Laws:<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\">1) New civil code entering in effect on\u00a0<b>01.10.2011<\/b>\u00a0allows for parents to agree on shared custody (so called joint physical custody). If both parents agree for such a plan (e.g. 2 weeks and 2 weeks) this would be generally accepted by the judge. \u00a0If the parents do not agree there is a \u201crebuttable presumption for joint legal custody\u201d . \u00a0Again the \u201cresidence\u201d (where the kid will live)in most of the cases will go to the mother. The judges are very reluctant to give the residence of the kid to father. They will never order shared residence (the law does not allow actually) if there is not a consensus of both parents. \u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\">2) A new law got in effect in 01.10.2013 (<a href=\"\/\/www.dreptonline.ro\/legislatie\/legea_257_2013_modificare_legea_272_2004_protectia_promovarea_drepturilor_copilului.php%20\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>Law 257\/30.09.213<\/b><\/span><\/a>) \u2013 it changes several aspects in relation with the divorce (success of ARPCC lobby efforts with the Ministry of Work):<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; Introduces in the legislation a definition of the \u201cbest interests of the child\u201d \u2013 the old law (<a href=\"\/\/www.dreptonline.ro\/legislatie\/legea_protectiei_copilului.php%20\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>272\/2004<\/b><\/span><\/a>\u00a0referred to best interests of the child but never explained how to asses them \u2013 thus most judges decided that \u201cit is in the best interest of the kid to stay with the mother\u201d. The new law offer some clear rules.<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; \u00a0The new law also prevents parents to renounce to the custody. This was needed because between 01.10.2011 and 01.10.2013 we had about 50% of the parents going at the divorce trial and telling the judge (told so by lawyers or by the other parent) that they do agree not to have the joint legal custody . Now this is explicit forbidden by the Law 257\/30.09.213 (success of my organization \u2013 ARPCC). We expect that about 20.000 children will not lose anymore the legal relationship (custody) with the father (most of \u00a0those who renounced were fathers)<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; \u00a0Has clear set of criteria for deciding the residence between the two parents \u00a0which does not include the \u201cgender\u201d of the parent:<\/span><\/p>\n<p><span style=\"color: #000080;\">o The opens of each parent to involve the other parent in the decisions related with the kid (the so called \u201cCalifornian principle\u201d)<\/span><\/p>\n<p><span style=\"color: #000080;\">o The openness of the parent to allow the other parent to preserve the personal relation with the other parent<\/span><\/p>\n<p><span style=\"color: #000080;\">o \u00a0The housing situation (e.g. which parent owns a house, how suitable is the house)<\/span><\/p>\n<p><span style=\"color: #000080;\">o \u00a0The history of violence of each parent against the kid<\/span><\/p>\n<p><span style=\"color: #000080;\">o \u00a0The distance between the houses of each parent and the school<\/span><\/p>\n<p><span style=\"color: #000080;\">We hope this will guide the judges, over time, not to use the \u201ckid goes to mother\u201d invisible criteria. But are pessimistic this would actually significantly change the situation on short and medium term. The \u201cmaternal preference\u201d is far to rooted in the minds of the divorce judges.<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\"><b>Mediation and parenting plans:<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\">As of 2013 all the people who goes to Court needs first to go for mediation \u2013 it is expected this would help some parents not to enter the court and to write parental plans together with the mediators. Those parental plans are expected to offer the kid more time with the other parent. We do not have numbers how many divorces with kids are solved by mediators. My estimation is that this is about 10-20% no more. ARPCC published a \u201cminimal standard parental plan\u201d, see it\u00a0<a href=\"\/\/www.arpcc.ro\/wiki\/plan-parental\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>here<\/b><\/span><\/a>\u00a0(editable) or\u00a0<a href=\"\/\/docs.google.com\/file\/d\/0B-iOqOKLc35PYjk3NDZkYjMtMTM4Zi00YjI2LWFjMWEtYmUxY2NmODM4MTcy\/edit\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\"><b>here<\/b><\/span><\/a>\u00a0(a filled one) \u00a0which many mediators are using as a \u201cstructure\u201d. \u00a0However the Ministry of Justice did not want to make official the term \u201cparental plan\u201d. This term\/idea is used by many parents, lawyers, mediators \u00a0and even judges. The official term is called \u201ctransaction\u201d or \u201cdeal\u201d.<\/span><\/p>\n<p><span style=\"color: #000080;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000080;\"><b>Time spent by child with the parents:<\/b><\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; If parents agree for shared custody this would be between 40-60% &#8211; typically this is \u201c<span style=\"text-decoration: underline;\">one week with mother and one week with father<\/span>\u201d or \u201c<span style=\"text-decoration: underline;\">two weeks with father and two weeks with mother and during the two weeks the kids meet the other parent 1-2 times\/week<\/span>\u00a0+ about \u201c<span style=\"text-decoration: underline;\">half of holidays<\/span>\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211; If parents do agree also for joint legal custody (and they mediate\u00a0<span style=\"text-decoration: underline;\">or<\/span>\u00a0if the non-residential parent has good lawyers, \u00a0proves a lot of involvement and meets an open minded judge, he will get probably more than \u201c<span style=\"text-decoration: underline;\">one week every 14 days<\/span>\u201d \u2026 e.g. he will also get\u00a0<span style=\"text-decoration: underline;\">1-2 days per week to visit the kid for few hours<\/span>, or in rare cases might be overnights + about \u201c<span style=\"text-decoration: underline;\">half of holidays<\/span>\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">&#8211;
